Regulation (EU) 2024/1689 governs the development and use of artificial intelligence across the European Union. As of this date, the transparency obligations set out in Article 50 become applicable, and they do not concern AI system developers alone. Chatbots, virtual assistants, AI-generated content, deepfakes and biometric recognition systems all fall within the scope of the new regulation. Penalties, with maximum fines of up to €35 million or 7% of total worldwide annual turnover for the most serious infringements, are now enforceable. It is worth clarifying what is coming into force now and what has already been postponed. The Digital Omnibus does not suspend the regulation as a whole: it only postpones the obligations concerning high-risk systems until 2 December 2027 or 2 August 2028, depending on the category. At the same time, important provisions on transparency, supervision and enforcement for general-purpose AI models are becoming effective. The requirements concerning AI literacy for staff (art. 4) and the prohibition of banned practices (art. 5), on the other hand, have already been in force since February 2025. From an operational perspective, the new deadline creates a clear organisational requirement for Italian companies: knowing where AI systems are already being used. A survey limited to contracts held by the IT department only captures part of the picture. Many systems enter organisations through individual accounts, features added to software that has already been purchased, marketing platforms or tools used by external agencies.
